General Terms and Conditions (GTC) for allbirds.com.pl
1. Scope
These General Terms and Conditions apply to all orders placed by consumers residing in the European Union via the online shop of CHRIS box AG, Fabrikstrasse 10, 8360 Eschlikon (CH), Tel.: +41 71 969 66 00, E-mail: info@chris-box.eu, VAT No.: ATU76804059 (hereinafter “CHRIS box”).
The version of the GTC valid at the time of the order applies.
2. Offer and conclusion of contract
2.1 The presentation of products on allbirds.de does not constitute a legally binding offer but an invitation for the customer to submit a binding order (offer to conclude a contract).
2.2 By clicking the “Buy Now” button, the customer submits a binding order for the products listed on the order page.
2.3 Upon receipt of the order, CHRIS box immediately sends an e-mail confirming receipt. The purchase contract is only concluded when CHRIS box sends a shipping confirmation (order/shipping confirmation) or at the latest upon delivery of the goods.
2.4 Discount codes or vouchers cannot be applied after the order has been completed.
3. Right of withdrawal
3.1 Statutory right of withdrawal
Right of withdrawal
Consumers have the right to withdraw from this contract within 14 days without giving reasons.
The withdrawal period is 14 days from the day:
- on which you or a third party designated by you, who is not the carrier, have taken possession of the goods, or
- in the case of several goods delivered separately – the day you have taken possession of the last item.
To exercise your right of withdrawal, you must notify us — CHRIS box AG (Fabrikstrasse 10, 8360 Eschlikon/CH, Tel.: +41 71 539 13 21, E-mail: info@chris-box.eu) — of your decision to withdraw from this contract by means of a clear statement (e.g., a letter or e-mail). You may use the provided withdrawal form, but this is not mandatory. To meet the withdrawal deadline, it is sufficient to send the notification before the period expires.
Consequences of withdrawal
When you withdraw, we will refund all payments received from you, including standard delivery costs (excluding additional costs arising from choosing a different delivery method). Refunds will be made promptly, no later than 14 days after receipt of your withdrawal notice.
Refunds will be made using the same payment method used in the original transaction unless we mutually agree otherwise. No fees will be charged for the refund.
We may withhold the refund until we receive the returned goods or until you provide proof of shipment — whichever occurs first.
You must return the goods within 14 days from the day you notify us of your withdrawal to:

The return is free of charge for you.
You are responsible for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
Exclusions of the right of withdrawal
The right of withdrawal does not apply to contracts:
- for goods manufactured to customer specifications or clearly tailored to personal needs,
- for goods not suitable for return for hygiene reasons if their seal was broken after delivery.
3.2 Voluntary 30-day return policy
In addition to the statutory right of withdrawal, we offer a voluntary return option within 30 days of receipt of the goods.
Goods may also be returned after the statutory 14-day period if they are:
- unused,
- undamaged,
- in their original packaging.

After inspection, the purchase price will be refunded using the original payment method.
The voluntary return policy does not apply to:
- damaged or used goods,
- goods without original packaging,
- custom-made or personalized goods, or goods whose seal was broken after delivery.
The statutory 14-day right of withdrawal remains unaffected.

Note
The statutory 14-day right of withdrawal remains unaffected by the voluntary 30-day return policy.
4. Prices and shipping costs
4.1 Product prices include VAT and all other price components. Prices are shown in euros (EUR).
4.2 Depending on delivery address, quantity, and product type, additional shipping costs may apply. Exact costs are displayed during checkout. For deliveries within Poland, no additional fees are charged.
5. Delivery conditions
5.1 Orders are prepared and dispatched within 1–3 days unless otherwise stated.
5.2 The delivery period is a maximum of 30 days from the conclusion of the contract unless agreed otherwise.
5.3 If not all products are available, CHRIS box may make partial deliveries at no extra cost.
5.4 If delivery fails due to three unsuccessful attempts caused by the customer, CHRIS box may withdraw from the contract. Payments already made will be refunded.
6. Payment terms
6.1 CHRIS box accepts the following payment methods: credit card and PayPal.
6.2 For credit card payments, the charge is made at the time of the order unless agreed otherwise.
6.3 Offsetting claims that are not acknowledged or legally enforceable is not permitted.
6.4 The right of retention may only be exercised for claims arising from the same contract.
7. Retention of title
The goods remain the property of CHRIS box until full payment is received. Before ownership is transferred, goods may not be pledged, assigned as security, modified, or altered without the consent of CHRIS box.
8. Warranty
8.1 The statutory warranty period is two years from delivery.
8.2 CHRIS box provides a warranty by remedying defects — either by repair or replacement.
8.3 If the repair fails, the customer may request a price reduction or withdraw from the contract.
8.4 Other statutory rights remain unaffected.
9. Liability
CHRIS box is fully liable for intent and gross negligence. For simple negligence, CHRIS box is only liable for breaches of essential contractual obligations and limited to foreseeable, contract-typical damages. The same applies to agents.
10. Data protection
CHRIS box processes personal data in accordance with the GDPR. For details, please see our privacy policy.
11. Final provisions
If any provision of these GTC becomes invalid, the rest of the contract remains unaffected. EU law applies unless mandatory consumer protection provisions in your country of residence take precedence.
The place of jurisdiction — where legally permissible — is Eschlikon (CH).
